Supreme Court decision on notary privilege
Today’s ruling on notarial privilege. The Supreme Court annuls unfounded complaint on behalf of two non-suspect notaries against the seizure – in a criminal investigation against another notary – of documents containing their names. The court did not sufficiently substantiate that there are very exceptional circumstances that justify breaking these notaries’ right to privilege. The mere fact that an earlier decision of the court allowed the accused civil-law notary’s privilege to be breached does not suffice.
