Tax litigation
Tax law is complicated. Disputes with the Dutch tax authorities on the correctness of returns are the rule rather than the exception. Also tax advisers and accountants are increasingly becoming targets of investigations. When the tax authorities believe that an incorrect tax return has been filed or underpaid ‘intentionally’, the tax dispute can be dealt with through criminal law. In addition, tax litigation is common regarding additional tax assessment, with or without a penalty. Our lawyers successfully assist clients in these disputes against the Dutch Tax Authorities. This includes assistance in the areas of:
– Book examinations, third-party examinations, and tax audits
– Residence and domicile investigations
– Information order procedures
– Tax proceedings (from objection to the Supreme Court)
– Tax penalty and accessory penalty
– Foreign asset matters
– International exchange of information
– Recovery of taxes and liabilities
